“Compliance is Key”
U.S. Customs and a large number of other Federal agencies work together to target violations of intellectual property rights compliance involving imported products. The National Intellectual Property Rights Coordination Center (IPR Center) is responsible for this coordinated effort but also is responsible for other wide-reaching enforcement actions for trade compliance issues.
The IPR Center is the coordination point for enforcement actions targeting import product safety, textile imports, trade remedy laws (ADD/CVD), Free Trade Agreements and other areas of potential fraud. Congress has advised Customs that Customs must increase enforcement actions in these areas and we are already seeing multi-million dollar settlements paid by companies that have been caught in violations of these trade laws.
Importers are strongly urged to understand all applicable laws, rules and regulations governing the products they import. This increased focus on enforcement actions is not just a short-term thing but is the new direction that Customs is pursuing. Companies that fail to comply risk severe civil and possible criminal penalties. Ignorance of the law is not a valid excuse.
