Two Texas-based importers of wooden furniture have been forced to pay $15 million to the U.S. government under the False Claims Act. The importers in question were accused of evading anti-dumping duties on wooden bedroom furniture from China. The U.S. Department of Justice alleged that the importers knowingly misclassified their imported products to avoid paying anti-dumping duty.
The allegations were first raised by a “whistleblower” and the DOJ indicates that the whistle blower will receive 25% of the amount paid as compensation for bringing forth this claim.
This is a great reminder to all importers that you must exercise reasonable care and due diligence in all your import transactions. Ignorance of the law is no excuse and penalties can be severe. Contact our office for more information and assistance.
